These Terms of Use govern your use of apxindustries.com and related APX websites (the “Site”), operated by APX Industries LLC (“APX,” “we,” “us”). By using the Site, you agree to these terms. If you do not agree, please do not use the Site.

Information only, not advice

Content on the Site is provided for general information about APX and its services. It is not investment, legal, tax, regulatory or other professional advice, and it should not be relied on as such. Advice is provided only under a signed engagement with APX.

No engagement created

Contacting us through the Site, by email or by phone does not create a client relationship. An engagement begins only when a written scope, term and fee have been agreed and signed.

Intellectual property

The Site and its content, including text, graphics, logos, the APX name and marks, and the design of the Site, are owned by APX or its licensors and are protected by intellectual property laws. You may view and print pages for your own internal, non-commercial reference. You may not copy, republish, distribute, modify or create derivative works from Site content without our prior written permission.

Acceptable use

You agree not to:

• Use the Site in any way that breaks the law or infringes the rights of others.
• Attempt to gain unauthorised access to the Site, our systems or any client platform.
• Interfere with the Site’s operation, or introduce malicious code.
• Use automated tools to scrape, harvest or copy Site content.
• Submit classified, export-controlled or other information you are not authorised to share.

Client platforms

Access to APX Monitor, Intelligence Reports and other client deliverables is limited to named users and is governed by the terms of your engagement or subscription. Sharing credentials or redistributing client materials is not permitted.

Third-party links and imagery

The Site may link to third-party websites we do not control, and we are not responsible for their content or practices. Use of U.S. Department of Defense imagery does not imply or constitute DoD endorsement.

Disclaimer

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, APX makes no warranties of any kind, express or implied, about the Site or its content, including accuracy, completeness, availability or fitness for a particular purpose.

Limitation of liability

To the fullest extent permitted by law, APX will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or business, arising from your use of, or inability to use, the Site.

Privacy

Our Privacy Policy explains how we handle information you submit through the Site.

Governing law

These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Virginia.

We may update these terms from time to time. The effective date above shows when they were last changed, and continued use of the Site means you accept the updated terms.
